These Terms of Service ("Terms") govern your use of the AI Traffic Survey application ("the App") provided by empsoft ("we", "us", or "our"). Please read these Terms carefully before using the App.

1. Acceptance of Terms

These Terms apply to all aspects of your use of the App. By downloading, installing, or using the App, you agree to be bound by these Terms.

2. Description of Service

The App is a traffic survey tool that uses your smartphone's camera and AI technology to automatically count vehicles and pedestrians.

  1. All AI inference is processed locally on your device
  2. Basic features are available without an internet connection
  3. Survey results are stored as statistical data on your device

4. Prohibited Uses

You must not engage in any of the following activities when using the App:

  1. Activities that violate laws, regulations, or public order and morals
  2. Activities related to criminal conduct
  3. Use for privacy-invasive purposes (such as monitoring or tracking specific individuals)
  4. Reverse engineering, decompiling, or disassembling the App
  5. Tampering with, copying, or redistributing the App
  6. Extracting, copying, or reusing AI models contained in the App
  7. Any other activities that we deem inappropriate

5. Disclaimer Regarding Survey Results

Important: AI-based measurements have inherent limitations. The accuracy of survey results is not guaranteed.
  1. AI inference results from the App are statistical estimates and are not guaranteed to be completely accurate
  2. Detection accuracy is affected by recording conditions (weather, lighting, angle, distance, etc.)
  3. Pedestrian gender and age estimates are statistical approximations and do not reflect the exact attributes of individuals
  4. We do not recommend using the App's survey results as official data for public traffic surveys
  5. We assume no liability for any damages arising from the use of survey results

6. Intellectual Property Rights

  1. All intellectual property rights related to the App belong to us
  2. Rights to survey data obtained by users through the App belong to the respective users
  3. Unauthorized copying or repurposing of AI models, source code, designs, or other elements contained in the App is prohibited

7. Service Changes, Suspension, and Termination

  1. We may change the content of the App or suspend or terminate its provision without prior notice to users
  2. We assume no liability for any damages incurred by users as a result of actions taken under this section

8. Limitation of Liability

  1. We do not warrant, either expressly or implicitly, that the App is free from defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or rights infringement)
  2. We are not liable for any damages incurred by users arising from the App, except in cases of our willful misconduct or gross negligence
  3. The App may not function properly due to device malfunctions, OS updates, or other technical factors

9. Changes to These Terms

  1. We may modify these Terms when we deem it necessary, without prior notice to users
  2. Modified Terms become effective upon being posted on this page
  3. Continued use of the App after modification constitutes acceptance of the modified Terms

10. Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Japan
  2. Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our place of residence
